The Ball State case has no application to us in Montana and is limited to the court’s jurisdiction in Indiana. I would also argue that we have authority through the BOR policy while they are arguing a “common law lien.”  Finally, we do have case law in our jurisdiction that has upheld our right to withhold transcripts.  Juras v. Aman Collection, 829 F.2d 739 (9th Cir 1987).  In that case, the Ninth Circuit court considered a case which involved a student debtor who had attended Montana State University.  The student debtor challenged the withholding of transcripts by the university because of outstanding debts.  The court upheld the university’s right to withhold the transcript as a means of debt collection.

This is interesting.  Putting a hold on the transcript is really one of the only avenues we have to try to get students to pay their bills.  I forwarded this to our business office as well as our Vice Chancellor for Administration and Finance.  The VC suggested that we as a group work to get something in the state statutes about this so if we get sued, we’re covered.  Maybe a good topic for the next meeting.

Probably a good place to add in “The university or college shall reserve the right to withhold records from the student in the event of an outstanding debt being owed unless subpoenaed by a court or tribunal of competent jurisdiction” or whatever legal mumbo jumbo Legislative Services comes up with.

 

If you know a legislator please share your thoughts and encouragement to get this on the books.

In chatting with Joe Hickman today, we agreed that Tony raises a troubling issue (that both of us missed in quickly skimming the policy document J).  I concur with Tony’s recommendation below on changing the wording of the note, so that we don’t provide potentially misleading information to students and/or parents.

Well – there are several confounding issues. 

 

Since there is no guideline as to how these courses will appear on a transcript, receiving institutions may be forced to accept these articulated courses as part of CCN.  I think some faculty, CAO’s, and accrediting or licensing organizations  may have a problem honoring credits offered through an articulation agreement from a non-accredited institution.

 

There is an issue in not posting these courses as transfer (or noted in some other/consistent way) so that receiving institution can sustain academic standards. 

For example:  MSU determines to articulate College Level Chemistry from Belgrade High School and we also chose not to indicate in any way on the transcript that these credits were earned through articulation as opposed to on-campus.  The student then decides to transfer to UM and study pharmacy.  Now UM is obligated to accept this chemistry as part of CCN and has no way of knowing that this course was not offered at an accredited college.  In this instance I think the PR nightmare begins as the accreditation of the UM Pharmacy school is called to question for transferring in courses offered at a high school (which is obviously not regionally accredited).

 

Assuming that we determine to indicate (on transcripts) that these credits are part of an articulation agreement.  There is a potential issue in undermining the intent of CCN. 

Consider the previous example except that in this case the course is indicated as transfer or articulated on the students transcript.  Now UM is obligated (by the note excerpted in my original email) to transfer in the credits.  However, the Pharmacy department determines not to accept the credits as part of the Pharmacy degree (citing accreditation concerns).  Now the political backlash occurs when the student’s aunt (who happens to have access to the public discourse in Montana) calls foul.  “We were told this course would articulate seamlessly into the Common Course Numbering system within the University system – we had no idea Johnny wanted to be a pharmacist when he took the course.  If these credits aren’t chemistry what are they!”  I think the words that have gone through Common Course Numbering and are should be cut from the note.

 

Frankly I think the first example is the larger issue in terms of academic standards and integrity.  The second issue could be inflammatory but the pharmacy schools actions have precedence in how we collectively treat transfer coursework.

 

Does this help clarify?  I have to admit I have a massive head cold and am recovering from some complications with my recent ACL surgery.  Perhaps I am missing the mark here.  If so, please just let me know.  I won’t be offended.

I still think this following statement is opening a can of worms that will eventually lead to a significant PR nightmare for the system. Essentially, this provision combined with the fact that there are no standards as to how the course will be posted on a transcript results in one school being able to determine transferability/articulation from a high school into any and all colleges in the state.  Please consider this from a faculty perspective before you move forward or approve.

 

Note:  All courses that have gone through Common Course Numbering and are locally articulated will be accepted throughout the Montana University System.  Students and Parents are responsible to work with college and high school counselors and advisors to research determine how coursework will transfer and whether it will satisfy particular program requirements.

 

Does no one else see this as a significant issue?  Am I missing something?

Re: feedback needed for OCHE Guide to High School for College Credit

I still think this following statement is opening a can of worms that will eventually lead to a significant PR nightmare for the system. Essentially, this provision combined with the fact that there are no standards as to how the course will be posted on a transcript results in one school being able to determine transferability/articulation from a high school into any and all colleges in the state.  Please consider this from a faculty perspective before you move forward or approve.

 

Note:  All courses that have gone through Common Course Numbering and are locally articulated will be accepted throughout the Montana University System.  Students and Parents are responsible to work with college and high school counselors and advisors to research determine how coursework will transfer and whether it will satisfy particular program requirements.

 

Does no one else see this as a significant issue?  Am I missing something?

Re: Dual Degrees/second degrees v.s. double major

Montana Tech's policies as stated in the catalog are:

 

Baccalaureate Degrees

The following are the requirements for a baccalaureate degree at MT Tech:

Bachelor of Science Degree

1.     The student must meet all the requirements of one of the curricula listed for the Bachelor of Science degree. Students can choose to complete the degree requirements in the catalog they enter under or any subsequent catalog published while they are continuously enrolled, but they must complete those requirements within six years from the date of the chosen catalog.

2.     At least 50% of the student's upper division (3000/4000 level classes) credits must be completed through Montana Tech, including any Senior Design/Capstone course work required for the degree.

3.     The student must achieve a minimum cumulative grade point average of 2.00 on all course work attempted (with repeats counted as indicated previously) as well as on all course work in the departmental major. No course below a "C-" will transfer or be acceptable toward degree

Second Baccalaureate Degree

1.     Montana Tech recognizes the first baccalaureate degree as having met the general education and skill requirements of the college.

2.     The course stipulations of the major for the second degree, including necessary prerequisites, as defined by the department, must be met.

3.     A person who earned his or her first degree at Montana Tech must complete at least 15 additional upper division credits in residence at Tech, including any Senior Design/Capstone course work required for the degree. A person who earned his or her first baccalaureate degree elsewhere  must complete at least, 50% of his or her upper division (3000/4000 level classes) credits through Montana Tech, including any Senior Design/Capstone course work required for the degree.

4.     The student must notify the Enrollment Services Office and the heads of the respective academic departments in writing of his or her intent to pursue a second degree at least a full semester prior to receipt of the degree.

5.     The student must achieve a minimum cumulative grade point average of 2.00 on all course work attempted (with repeats counted as indicated previously) as well as on all course work in the department. No course below a "C-" will transfer or be acceptable toward degree requirements

Good afternoon,

 

I was able to confirm over the weekend that we would not have any specific external speakers, and as such, here is the current agenda for the meeting at the end of the week.  Thus, it is the antithesis of the Fall meeting where we had dozens of external speakers.  Something to be said for variety.  J

 

·         If I named you as a facilitator (based on emails/conversations we’ve had) and you don’t love that, let me know!

 

·         If I didn’t name you as a facilitator and you’d like to be one, let me know that too!

 

·         And – if your topic didn’t make it on the agenda, I blame my current state of chaos, and I apologize, please let me know and we’ll add it!

 

·         If I spelled something wrong, I wasn’t an English major, but would like to correct it before we print several copies, please advise
