In-state Residency for a Non-citizen

Good afternoon everyone,

 

We have a unique situation we have recently encountered that we are unsure of how to proceed with.  We have a Canadian applicant who is currently in Montana on a spouse’s work visa.  He applied and went through our international/Canadian admission process; and now has completed a Residency Questionnaire in attempt to qualify for in-state status.  He has lived in Montana for over 12 months, has a MT driver’s license and MT vehicle registration.  BOR’s Residency doesn’t explicitly say anything about non-citizens not being eligible to qualify for in-state status.  We weren’t sure if that is simply an implied rule or not.  Could anyone provide clarity on this, or let us know if you’ve run into similar situations and how they were handled?
