Re: Residency & Fac/Staff Tuition Waiver Scenario

We had a similar situation.

 

Student was attending MSU on WUE.  The mom moved to Helena and established residency.  However, since the student was receiving the benefit of being an Oregonian (via the WUE) they needed to decline the WUE for one year before she could be considered a resident.  However, I could see the employment exemption being applied in this instance.  He came to the state for education, but he is in the state for his job (it would require some additional documentation to overcome the presumption, but he may be able to get that)

 

I would recommend forwarding this to OCHE legal counsel.  If you do, please let us know what you find out.

Hi MACRAO crew,

 

I have a residency question for the group. 

 

I have a student who was a WUE recipient through Autumn 2018.  He has since become a permanent employee (.75 FTE or greater) and has completed his 6 month probationary period as required for the faculty/staff tuition waiver.  However, he won’t qualify for in-state tuition until Spring 2020 under the residency policy.  He qualifies for the fac/staff tuition waiver in every other aspect starting Summer 2019, but it won’t disburse because he is not an in-state student.  This essentially makes him ineligible to use the fac/staff tuition waiver for 6 months past his probationary period.  Is this the case on all other campuses?  If not, how do you handle this?

 

I’ve run into this situation a couple of times now, so I thought I’d run it by the group to see how it’s handled around the state.
